Value Added Tax
In accordance with the provisions of article 21 of Law 37/1992, of December 28, on Value Added Tax, deliveries of goods dispatched or transported outside the Community by the seller or by a third party acting in name and on behalf of the latter; Therefore, deliveries of goods made to the Canary Islands will be subject to and exempt from Value Added Tax (VAT).
Canarian general indirect tax (IGIC).
In the Canary Islands, an import of goods will take place for the purposes of the Canary Islands General Indirect Tax (hereinafter, IGIC), whose taxable person is the recipient of the imported goods (article 21 of Law 20/1991, of June 7, modifying the fiscal aspects of the Canary Islands Fiscal Economic Regime).
In this sense, section 11 of article 14 of Law 20/1991, of June 7, modifying the fiscal aspects of the Economic Fiscal Regime of the Canary Islands provides that:
Imports whose global value does not exceed 150 euros will be exempt from the IGIC, provided they meet the following conditions:
The set of goods has a single recipient.
The assets have been included in the same summary declaration.
The goods are covered by the same transport contract.
In the case of imports whose overall value does not exceed 150 euros, it will not be necessary to present the corresponding DUA at customs. However, the exemption from submitting the DUA will not apply in the case of goods imported by sea, as provided in the Resolution of the Director of the Canary Islands Tax Agency, of July 2, 2017, which clarifies the Conditions for the dispatch of low value shipments exempt from the Canary Islands General Indirect Tax:
Imports whose global value exceeds 150 euros will not be exempt from IGIC and must present the corresponding DUA at customs.
